I have a question: Whats your obsession with Mario? This is also kind of plagiarising his hat and the shirt your character is wearing.But I like how I mentioned how you got it from Nintendo sorry about that! People dont really mention what a characters from so sometimes they could think its original.
I’m not really plagarizing if I give credit to the owners, also I really like the game so much, besides it’s just fanart for Nintendo. Also Maria is just a Nintendo game idea and well she’s basically the female version of you know, sorry about that. Every time I draw her or the outfit, I always credit the owners because first of all, they inspire me and second of all, I despise getting copyright striked.
The word plagiarism is a very strong word and implies, that someone takes the work of someone else and uses it to gain (money, etc). You should use that very carefully since you're the one accusing her of a crime when in fact she didn't do anything.
1. You don't need to credit Nintendo here on flipanim
2. Your drawings are your property
3. The idea/concept of Mario is not your property, but again, this does not matter, since you're not making any money with this art.
4. If you were to make money with your art or if you were to show your art on public events, then a Nintendo credit would not suffice. Instead you would have to get permission from Nintendo, which is a pain to get.
All of this aside. Artists reference other art (or realism) all the time. It is simply not possible to invent the wheel new everytime.
What do you think a remix of a song is? You can remix everything, as long as you don't gain anything from it. If money is earned with it, permission is necessary.

This isn't the full truth either. Example: Youtuber Lumpy Touch got himself a commission artwork from a very experienced artist, who basically made a Super-Mario / Jojo's Bizarre Adventure Mashup. It's cool and hilarious:

Nintendo is only mentioned in the hashtags, although Lumpy bought this artwork and showed it publicly on a YT video. There is no copyright claim.
